【摘要】：當(dāng)前,我國(guó)改革開放程度趨深,市場(chǎng)經(jīng)濟(jì)發(fā)展速度也越來(lái)越快,合同以其特有的表現(xiàn)形式,在現(xiàn)實(shí)的社會(huì)工作生活和市場(chǎng)經(jīng)濟(jì)發(fā)展中發(fā)揮著越來(lái)越重要的作用,然而,利用合同進(jìn)行詐騙的犯罪行為也越來(lái)越為普遍和常見。合同詐騙罪以正規(guī)合同為主要掩護(hù),以科技進(jìn)步為創(chuàng)新驅(qū)動(dòng),呈現(xiàn)出了詐騙金額日趨增多,布局隱蔽極難防范,詐騙手段推陳出新,案件牽連復(fù)雜難辨的特點(diǎn)和趨勢(shì)。同時(shí),在現(xiàn)實(shí)的司法實(shí)踐中,還往往存在合同詐騙罪難以有效認(rèn)定的難題,需要我們進(jìn)一步加深對(duì)合同詐騙罪的認(rèn)識(shí)與理解。筆者通過(guò)對(duì)合同詐騙罪的概念、構(gòu)成要件、類型的解析,對(duì)合同詐騙罪中“財(cái)產(chǎn)”、“合同”和“非法占有目的”的正確認(rèn)定,以及對(duì)合同詐騙罪與合同糾紛、民事欺詐行為及一般詐騙罪的區(qū)別的解析,加深了對(duì)合同詐騙罪的認(rèn)識(shí)與理解。筆者通過(guò)對(duì)當(dāng)前合同詐騙犯罪表現(xiàn)出的趨向特點(diǎn)的和成因進(jìn)行分析,闡述了當(dāng)前合同詐騙罪表現(xiàn)出的新特點(diǎn)和發(fā)展趨勢(shì),指出了當(dāng)前合同詐騙的常用手法和手段,以期提高市場(chǎng)主體的防范合同詐騙能力。筆者對(duì)現(xiàn)實(shí)市場(chǎng)主體預(yù)防和防范合同詐騙犯罪指出了改進(jìn)方向,對(duì)現(xiàn)實(shí)實(shí)踐中合同詐騙罪認(rèn)定難的問(wèn)題提出了司法建議,希望能為司法實(shí)踐中合同詐騙罪的準(zhǔn)確定罪量刑,為我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)秩序的正規(guī)化建設(shè),做出微薄貢獻(xiàn)。
[Abstract]:At present, with the deepening of reform and opening up, the market economy is developing faster and faster. The contract, with its unique form of expression, plays a more and more important role in the social work life and the development of the market economy. The crime of using contracts to defraud is becoming more and more common. The crime of contract fraud takes the formal contract as the main cover and the science and technology progress as the innovation drive. It presents the characteristics and trends of the increasing amount of fraud, the hidden layout extremely difficult to prevent, the new means of fraud, the complicated and difficult to distinguish the case implicated. At the same time, in the actual judicial practice, there is often a difficult problem that the crime of contract fraud is difficult to identify effectively, which requires us to further deepen the understanding and understanding of the crime of contract fraud. By analyzing the concept, elements and types of the crime of contract fraud, the author correctly identifies "property", "contract" and "purpose of illegal possession" in the crime of contract fraud, as well as the dispute between the crime of contract fraud and the contract. The analysis of the difference between the civil fraud and the general crime of fraud deepens the understanding of the crime of contract fraud. Based on the analysis of the characteristics and causes of the current contract fraud crime, the author expounds the new characteristics and development trend of the current contract fraud crime, and points out the common methods and means of the current contract fraud crime. The aim is to improve the ability of the main body of the market to prevent contract fraud. The author points out the direction to improve the prevention and prevention of contract fraud crime in the real market, and puts forward some judicial suggestions on the problem that it is difficult to identify the contract fraud crime in the practical practice, in the hope that it can accurately convict and sentence the contract fraud crime in the judicial practice.
