【摘要】：正2014年11月18日,最高人民法院、最高人民檢察院聯(lián)合發(fā)布了《關(guān)于辦理危害藥品安全刑事案件適用法律若干問題的解釋》(以下簡稱《解釋》),自2014年12月1日起實施。該《解釋》根據(jù)《刑法修正案(八)》的有關(guān)規(guī)定,結(jié)合社會經(jīng)濟發(fā)展和司法實踐中的新情況新問題,針對實踐中辦理危害藥品安全刑事案件存在的爭議問題提出了明確意見,同時進一步明確了有關(guān)危害藥品安全犯罪的定罪量刑標準。為便于理解和適用,現(xiàn)對《解釋》的制定背景、過程和主要內(nèi)容作如下說明:一、制定《解釋》的背景及過程近年來,隨著社會經(jīng)濟的快速發(fā)展,制售假藥、劣藥違法犯罪活動猖獗,呈現(xiàn)高發(fā)態(tài)勢,嚴重
[Abstract]:On November 18, 2014, the Supreme people's Court and the Supreme people's Procuratorate jointly issued the interpretation of the applicable Law on handling Criminal cases against Drug Safety (hereinafter referred to as "interpretation"), which will come into effect on December 1, 2014. According to the relevant provisions of Criminal Law Amendment (8), combined with the new situation and new problems in social and economic development and judicial practice, this paper puts forward some clear opinions on the controversial problems existing in handling criminal cases against drug safety in practice, and further clarifies the criteria for conviction and sentencing of crimes against drug safety. In order to facilitate understanding and application, the background, process and main contents of the formulation of the interpretation are explained as follows: first, the background and process of the formulation of the explanation in recent years, with the rapid development of social economy, the manufacture and sale of counterfeit drugs, the illegal and criminal activities of inferior drugs are rampant, showing a high incidence and serious situation.
